Festival marred by dispute

Members of Garden City's Vietnamese community are using America's political system to voice their views on a music festival Sunday planned to celebrate diversity.
Dr. Chuong Le has exercised his freedom of speech rights to protest the festival while organizers used the court system to obtain a temporary restraining order and charged Le with defamation.
As Garden City plans a month-long celebration of its diverse cultures, a lawsuit was filed Tuesday in Finney County District Court to make sure protesters don't interrupt Sunday evening's Vietnamese music festival.
Le of Garden City has stated in a written release "the Vietnamese Americans are organizing a demonstration, which will take place at the Plaza Inn on Sept. 2 at 7 p.m., to protest an emcee of the coming festival who has, in the opinion of (the) Vietnamese Community, insulted the former South Vietnamese Air Forces and Allies (including the United States) through the showing of a video, Paris by Night No. 40."
As part of "Garden City is America," members of the Vietnamese community are sponsoring a program of Vietnamese music at 8 Sunday night. Emcees for the program are Nguyen Ngoc Ngan and Nguyen Cao Ky Duyen. The band, The Destiny, and comedian Quoc Boa also will
perform.
But Ken Nguyen, one of the organizers of the festival and owner of Golden Dragon restaurant here, said the festival organizers have filed a lawsuit against Le claiming five counts, including defamation for inferring they were Communists.
"This is a disgrace," Nguyen said. "I'm ashamed to call him a countryman."
Nguyen said the problem arose from the music video, "Mother," produced by the company, Paris By Night, which depicted U.S. and South Vietnamese planes bombing Vietnamese people.
Nguyen said it was an editing mistake by the company, which recalled the video and deleted the objectionable scenes. The emcee Le objects to is Nguyen Ngoc Ngan, appeared in the video "Mother."
"It should have been picked up," he said of the video's editing problems. "It was terrible editing."
The city, which is using the festival as a kickoff for its "Garden City is America" celebration this month, said there was no intent to upset anyone.
Vince DiPiazza, assistant city manager, said the city has not been formally contacted to his knowledge about the protest, but is aware of it.
"No one was trying to offend anybody," he said. Nguyen said the group has filed a lawsuit claiming defamation because Le is connecting them with the Communism regime for their involvement with the festival.
Nguyen also has received a temporary restraining order to force the protesters to stay at bay.
"The restraining order is a buffer zone," he said. "In fact, we even sprayed painted lines where they can and where they cannot be."
Nguyen is not happy that the celebration aimed at honoring the Vietnamese community is under attack.
"I'm worried the damage it will do to the community, the name of the Vietnamese community and our names," he said.
Despite the swirl of controversy, "Garden City is America" will spend the month educating the community about its people.

We, the Vietnamese-Americans Community in the United States, will hold a protest at Garden City Plaza Inn, from 8PM to 12 PM, this coming Sunday, September 2, 2001.
We are protesting this musical event which falls on the special occasion in the Communist Vietnam 56 years ago when Ho Chi Minh, the bloody symbol, took over Vietnam.
On this day in Vietnam, the Vietnam Communist Party will celebrate, but NOT the people inside Vietnam and especially NOT the overseas Vietnamese.
This musical event in Garden City, Kansas will be utilized by the Ha Noi propaganda machine to show that the Vietnamese-Americans support the current bloody regime, whether the local organizer intend this way or not!!
We have discussed with the local organizer, Mr. Minh Duong, the Human Resources Director of IBP Holcomb Plant, about the emotional sufferings for the local Vietnamese-American IBP employees [former Vietnam Communist Political Prisoners].
We have written to the IBP Corporate Headquarter about the Vietnamese-American employees emotional sufferings from this musical event, organized by the IBP Holcom Plant Human Resources Director, Mr. Minh Duong.
Over 26 years and the Vietnam War memory still is in the heart of the American public. To the IBP Vietnamese-American employees, they don't want to be reminded about the Vietnamese Communist Special Day in America which this musical event will.
The presence of Master of Ceremony Nguyen Ngoc Ngan creates further speculation that this coming musical event will be a propaganda for the Vietnamese Communist Party whether the local organizer intend this way or not!!.
MC Ngan appeared in a musical video called "Thuy Nga Paris By Night 40" which inflicted the wrong impression about the South Vietnamese Air Force. There was symbol of the North Vietnamse Flag in this music video. Mr. Ngan was protested in Wichita, Kansas in a musical event 3 years ago by 500 Vietnamese-Americans.
This coming protest will have the Vietnamese-Americans from Wichita (Kansas), Denver (Colorado), Oaklahoma City (Oaklahoma) and Texas.
We want peace in America, the land that housed us from the Vietnamese Communist political and religious persecution. Is it too much to ask that this musical event be organized on another day, instead of September 2, 2001- and without the MC Nguyen Ngoc Ngan ??

After this secret document dated JUNE 24,1999,in the state of Colorado, on August 19, 1999, two civil cases were filed against Thich Chanh Lac and Nguyen Anh Tung.

CUONG KIM LE a/k/a THICH CHANH LAC, TUNG ANH NGUYEN and CHANH DAO NEWSPAPER, a weekly newspaper in San Jose.
Beginning in October 11, 1998 and continuing weekly for over two months in 1998, Plaintiff participated in the protests at Nhu Lai temple.
On October 24, 1998, Chanh Dao published an article containing the following statements:
- The article quoted Rev. Thich Chanh Lac as saying "This is a conspiracy driven by long arm of the Vietnamese Communist Government in Hanoi".
- The article quoted TUNG NGUYEN as saying "The main purpose of these protests... is to destroy the investigation of the United Nation Committe for Reglious Freedom presently in
Vietnam".

On October 18, 1998, during the course of an interview by a newspaper reporter (Denver Post), defedant Le stated:
"This is a conspiracy of the servants from North Hanoi"
Defendant Nguyen Anh Tung stated: "This is an intelligence operation by Ha Noi".
On December 12, 1998, defendant Le and Nguyen Anh Tung at the question and answer session in Colorado Spring, Tung said the following:
"The Vietnamese Communists have three strategies: High, Medium, and Low way. High Strategy: using Miss Thu to dishonor the Master. Medium Strategy: to convince the Temple Management to REPLACE the monk, or the monk is not allowed to SPEAK about or FIGHT against the Communist. The Communist is not successful on High Strategy, now they went to the Medium Strategy".
